Terms and conditions
These terms and conditions are concluded between MERAKI LL SRO, whose registered office is located at Karlovo náměstí 287/18, Nové Město, 12000 Prague, Czech Republic, registered in the Commercial Register of Prague under number CZ21327998, hereinafter referred to as "MERAKI LL SRO", and any natural or legal person who wants to make a purchase via the website https://oliviersandco.cz/ (hereinafter referred to as the "buyer").
Article 1: Subject matter
This document regulates the relationship between MERAKI LL SRO and the buyer and the terms and conditions that apply to each purchase made through the website https://oliviersandco.cz/ . Purchasing a product on this website means full and unreserved acceptance of these terms and conditions, and the buyer confirms that he is familiar with these terms and conditions before placing an order. The buyer declares that the purchase of products on the website https://oliviersandco.cz/ is not directly related to his professional activities and is intended exclusively for personal use. The buyer further declares that he has full legal capacity to conclude this contract.
MERAKI LL SRO reserves the right to modify these terms and conditions at any time to comply with new legislation or to improve the use of the website. The valid terms and conditions are those in effect on the date of the order.
Article 2: Products
Products offered on the website https://oliviersandco.cz/ are available while supplies last. MERAKI LL SRO reserves the right to change the product range at any time. Each product is described on the website with its main technical characteristics (volume, use, composition, etc.). Product photos are as accurate as possible, but are not binding on the seller. The sale of products on the website https://oliviersandco.cz/ is intended for all buyers who live in countries where the import of these products is permitted.
Article 3: Prices
The prices listed on the product pages in the online catalog are in euros (€) including VAT, which is valid on the day of the order. A change in the VAT rate may affect the price of the products. MERAKI LL SRO reserves the right to change prices at any time, and the price valid on the day of the order will be final for the buyer. Prices do not include shipping costs, which are charged additionally based on the total value of the order. In the Czech Republic, shipping is free for orders over 1500 CZK, for orders below 1500 CZK a shipping fee of 180 CZK for home delivery or 79 CZK for delivery to a point of delivery is charged.
Article 4: Order and payment terms
Before placing an order, the buyer must create an account on the website https://oliviersandco.cz/ . The account creation section is directly accessible from the side menu. Any visitor who wants to place an order or consult their account (order status, profile, etc.) must log in using their details. The website https://oliviersandco.cz/ allows the buyer to order and pay for products using the following methods:
- Secure payment by card (via Shopify Payments) : The buyer selects the products they want to order in the "cart", edits the quantity or reference numbers, verifies the delivery address or enters a new one. The shipping costs are then calculated and displayed to the buyer, as well as the name of the carrier. The buyer chooses the payment method, selects "Payment by card". The next step is to check all the information, accept the terms and conditions by checking the appropriate box and confirm the order. The buyer will then be redirected to the secure Shopify Payments payment gateway, where they securely enter their payment card details. If the payment is approved, the order is confirmed and the contract is concluded. Payment by card is irrevocable. In the event of card misuse, the buyer can request the cancellation of the card payment.
Article 5: Expropriation
MERAKI LL SRO retains full ownership of the products sold until the price, including all fees and taxes, has been paid in full.
Article 6: Withdrawal from the contract
In accordance with Article L121-20 of the French Consumer Protection Code, the buyer has the right to withdraw from the contract within fourteen working days of delivery of the order without giving any reason, either by exchange or return of the goods, excluding the costs of returning the goods.
Article 7: Delivery
The products will be delivered to the address indicated in the order, which must be in the geographical area where delivery is permitted. Delivery is provided by Packeta, with the possibility of tracking the shipment and without signature. Delivery times are indicative and if they exceed 30 days from the order, the contract may be cancelled and the buyer will receive a refund.
Article 8: Liability
MERAKI LL SRO is not responsible for any damage incurred while using the Internet, such as data loss, virus, service interruption or other unexpected problems.
Article 9: Intellectual property
All elements of the website https://oliviersandco.cz/ are the intellectual property of MERAKI LL SRO. No one may reproduce, use or otherwise exploit any element of the website (photographs, logo, texts, etc.).
Article 10: Personal data
MERAKI LL SRO undertakes to protect the confidentiality of information provided by the buyer, which may be used for certain services. All information about the buyer is subject to Law No. 78-17 of January 6, 1978. The buyer has the right to access, rectify and delete his data.
Article 11: Dispute Resolution
These terms and conditions are subject to Czech law. In the event of disputes, the competent court will be in Prague.
